A German court has delivered a landmark ruling in a climate lawsuit brought by Peruvian farmer, Saúl Luciano Lliuya, against German energy giant RWE. The German Higher Regional Court of Hamm has ruled that, in principle, companies can be held liable to people halfway around the world for their contribution to the impacts and risks of climate change . While the Court ultimately dismissed Mr Lliuya’s claim, its reasoning represents a significant breakthrough for climate litigation globally. Below we explain what the Court decided, why it matters, and what it might mean in a New Zealand context with Smith v Fonterra still moving through the courts.

De EU actualiseert haar verordening over duurzaam gebruik van pesticiden (SUR). Het voorstel van de commissie bevat slechts kleine verbetering en maakt geen plaats om de weg vrij te maken voor een duurzame en gifvrije landbouw. Pesticiden zijn een belangrijke oorzaak van het verlies aan biodiversiteit en een gezondheidsrisico voor mensen, vooral voor degenen die in de buurt van boerderijen werken en wonen. Daarom is het belangrijk dat de EU overstapt van het huidige landbouwsysteem dat afhankelijk is van schadelijke stoffen.

Farming is a complex issue on the journey to net zero, as it is both a source and sink for emissions. About 20% of global emissions come from agriculture and land use, and this rises to more than 25% for the food system as a whole, which includes processing, packaging and transport.
